Standard Warranty and Returns (RMA)


Standard Warranty
PRODUCTS COVERED:

  • Max Cole FA1XX Series IP PBX and Related Accessories
  • Max Cole RT110 Firewall
  • Max Cole TC110 Thin Client

DURATION: 1 year

  1. Max Cole warrants Max Cole hardware, accessories, and supplies against defects in materials and workmanship for the period specified above. If Max Cole receives notice of such defects during the warranty period, Max Cole will, at its option, either repair or replace products which prove to be defective. Replacement products may be either new or like-new.
  2. Max Cole warrants that Max Cole software will not fail to execute its programming instructions, for the period specified above, due to defects in material and workmanship when properly installed and used. If Max Cole receives notice of such defects during the warranty period, Max Cole will replace software media which does not execute its programming instructions due to such defects.
  3. Max Cole does not warrant that the operation of Max Cole products will be uninterrupted or error free. If Max Cole is unable, within a reasonable time, to repair or replace any product to a condition as warranted, customer will be entitled to a refund of the purchase price upon prompt return of the product.
  4. The warranty period begins on the date of delivery or on the date of installation if installed by Max Cole. If customer schedules or delays Max Cole installation more than 30 days after delivery, warranty begins on the 31st day from delivery.
  5. Warranty does not apply to defects resulting from (a) improper or inadequate maintenance or calibration, (b) software, interfacing, parts or supplies not supplied by Max Cole, (c) unauthorized modification or misuse, (d) operation outside of the published environmental specifications for the product, or (e) improper site preparation or maintenance.
  6. TO THE EXTENT ALLOWED BY LOCAL LAW, THE ABOVE WARRANTIES ARE EXCLUSIVE AND NO OTHER WARRANTY OR CONDITION, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED AND Max Cole SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.
  7. TO THE EXTENT ALLOWED BY LOCAL LAW, THE REMEDIES IN THIS WARRANTY STATEMENT ARE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES. EXCEPT AS INDICATED ABOVE, IN NO EVENT WILL Max Cole OR ITS SUPPLIERS BE LIABLE FOR LOSS OF DATA OR FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT OR DATA), OR OTHER DAMAGE, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE.
  8. TO THE EXTENT LOCAL LAW MANDATORILY REQUIRES A DEFINITION OF “LIFETIME WARRANTY” DIFFERENT FROM THAT PROVIDED HERE, THEN THE LOCAL LAW DEFINITION WILL SUPERSEDE AND TAKE PRECEDENCE.

Limitation of Damages
Max Cole's ENTIRE LIABILITY FOR ANY DEFECTIVE PRODUCT SHALL IN NO EVENT EXCEED THE PURCHASE PRICE FOR THE DEFECTIVE PRODUCT. THIS LIMITATION APPLIES EVEN IF Max Cole CANNOT OR DOES NOT REPAIR OR REPLACE ANY DEFECTIVE PRODUCT AND YOUR EXCLUSIVE REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Limitation of Remedies
YOUR EXCLUSIVE REMEDY FOR ANY DEFECTIVE PRODUCT IS LIMITED TO THE REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT.

Max Cole may elect which remedy or combination of remedies to provide in its sole discretion. Max Cole shall have a reasonable time after determining that a defective Product exists to repair or replace a defective Product. Max Cole's replacement Product under its limited warranty will be manufactured from new and serviceable used parts. Max Cole's warranty applies to repaired or replaced Products for the balance of the applicable period of the original warranty or ninety days from the date of shipment of a repaired or replaced Product, whichever is longer.

Extended Warranty
Customers can purchase an extended warranty on eligible Max Cole products with less than a 3-year warranty. The maximum warranty period for these products, including any warranty extension, cannot be longer than 3 years from the date of purchase. Extended warranty is available with purchase of Platinum Support Package

Warranty Limitations
Max Cole's limited warranty provides that, subject to the following limitations, each Product will be free from defects in material and workmanship and will conform to Max Cole's specification for the particular Product.

Return Material Authorization (RMA)
No Product may be returned directly to Max Cole without first contacting Max Cole for a Return Material Authorization ("RMA") number. If it is determined that the Product is defective, you will be given an RMA number and instructions for Product return. An unauthorized return, i.e. one for which an RMA number has not been issued, will be returned to you at your expense. Authorized returns are to be shipped prepaid and insured to the address on the RMA in an approved shipping container. Your original box and packaging materials should be kept for storing or shipping your Product.

IMPORTANT - To qualify for the warranty, the end user must:

* Be the original registrant of this product online at: http://www.maxcole.com/warranty/register/
* Be the original purchaser with proof of purchase from an Max Cole partner.
